Bail Hearings

Programs that hold hearings and issue decisions regarding the release from custody of individuals charged with a criminal offence while awaiting their trial. Depending on the jurisdiction, the decision to grant or deny bail is made by a judge or a justice of the peace, taking into consideration the evidence brought forward, the risk for public safety as well as the safety of victims or witnesses. Options may include release without conditions, release on the individual's own recognizance, release on non-financial conditions that require monitoring the defendant in the community, setting bail in the form of property, cash, or surety that the defendant must post in order to be released or ordering the defendant retained in confinement without bail (which occurs when the individual is considered a flight risk or a danger to the community).
